company A applied for my GC. They cant provide me jobs.
I am working with company B as a contractor (corp to corp with company A and B).. project will finish in a month. already did not work for 12 months even though my I-485 is pending with company A.
now company B offered me to work perm with them by using EAD. while my H1b renewal is pending with company A.
can I work with B while A is still my sponsoring company.
my Q is once h1b approves lets say in a month and renewal for 1 year( can I work with B with EAD for like another 6-8 months and then go out and reenter for H1b with A?

Please correct me if I am wrong i.e. I can continue working as I have already applied for my H1 extension and whatever the H1 extension response is based on that if it is approved I can stay on H1 else if extension denied for some reason then at that point I can move to EAD and file a new I-9 Form with my employer and continue my work.

yes you can continue working. Assuming that USCIS honors the original filing date (ie. they assume that your H1 extension was filed before the previous H1 ran out) and gives you a I-94 in the approval you are all set. Make sure your lawyer includes proof that you filed on time, but to the wrong center. IN the worst case if the extension is denied (or approved without an I-94) you can always move to EAD and continue working. The time you spent working past your original I-94 expiry would however then count as unauthorized.

Hi Hope2007,
Did you talk to your attorney? How were you able to do so?
My attorney says I can do so, I have asked him how.
Our corporate office handles all and I do not have any information about this. I hope my attorney is correct and I do not find myself in trouble after I change location.
Please post hope2007 if you know how this is possible.

You dont need to inform USCIS about new passport, but make sure you carry your old as well as new passport, dont discard the old passport as yet.

hey Waiting Game,
the consulate in mumbai is in a very expensive area called 'breach candy' its like the beverly hills in CA.
however, u may get decent stay outside 'Dadar' or 'bombay central' railway station. these are close to the consulate but since u have a morning hour commute towards downtown mumbai, it will take at least 30-45 minutes. so give urself adequate time. avoid 'bandra', churchgate, grant road areas.
if u just need to spend the nite, u can spend it on the airport.
let know if any questions and wish u all the best.

I think the Medical's are valid for 18 Months and not one year.I checked this out when i took infopass.Correct me if i am wrong .

I am curious to know if people are sending amounts >20K by wire transfer to India or other countries from the US. People who do that regularly or have done that in past, have you encountered any problems? Wire transfers are directly informed by the bank to the IRS and you do not have to do it personally right?

I did some research on murthy.com and found that AC21 did abolish 'per country of birth quota' on recycled numbers. I am posting a link to this murthy.com article of Oct 6, 2000 which clarifies the issue.

"Under Section 104, with respect to immigrant visas, the per country quota, which has been adversely affecting those from China and India and which the U.S. State Department had stated could possibly affect those from the Philippines in the near future, may have been resolved with this Bill. It has always been the case that not all of the available immigrant visas were issued, since most countries did not have enough applicants to use the total available. ACTA provides that if the INS or the U.S. State Department does not issue all of the immigrant visas that should be issued in that FY, the unused immigrant visa numbers should be made available to all countries without the per country quota limit applying."

It is clear guys we have to concentrate our energy and our thoughts on this quota. When I go online to get the visa appointment for parents I'm not able to get a date and this has been going since 25 days(It asks to check back in 24 hours)

Hello ncgc, Please post your experience once you get the card back. My spouse (filed seperate) has the the same issue. She received the EAD card with wrong photo and today she received the AP with the wrong photo as well. We are going to send it back to the lawyer, so he can follow up with INS. Is your AP photo looks ok?

We (3 of us from the PA state chapter) had a meeting with Congressman Joe Sastak's office staff in Media, PA.
The staff member was completely unaware of our issues (other than, FBI name check takes long time and USCIS processing is slow). However, she was eager to understand our problems.
She recommended that we should meet the office staff in DC since they handle issues related to legislations.

Anotehr question in thsi regard, say ur I-94 expired and you applied for and got h1 renewal, and the new I-797 has the new I-94 in it, so we cut it from there and staple it to our passports ???
And when we leave the country we surrender both the I-94s ???

At this time ONLY 30% of EB2 Indians have current PDs. I've asked this question before - don't you all think that maybe dates will not have to retrogress again? I mean, 30% is too low a percentage for triggering a backward movement of PD.
Any thoughts?

Thanks for your reply. I am also in the same dilemma over where to file, according to I765 instructions i need to mail to NSC but my I140, I485 ,EAD and AP all are in TSC. Customer Service rep tells me to follow the Instructions in I765 form for where to File.
