CBS News: It was unclear yesterday whether Clinton's comments were simply a prediction or mistake or whether instead she was getting ahead of a planned announcement by the administration.
Now a senior administration official tells CBS News that the federal government will indeed formally challenge the law when Justice Department lawyers are finished building the case. The official said Justice is still working on building the case.
The administration is going to lose this lawsuit. The Arizona law is basically a lesser version of the Federal law. The only real difference is that Arizona actually intends to enforce their law.
Obama is obviously bringing this losing lawsuit to gain more misguided Hispanic support for the Democratic Party and he will be successful to a certain degree. However, an Arizona win will most likely lead to other border states copying Arizona’s law (save the nut jobs in California). Furthermore an Arizona win will propel Governor Jan Brewer from mere rock star status in the GOP to The Palin League (Palin/ Brewer 2012, anyone?).
It will be interesting to see just what angle of attack the administration plans to use to challenge Arizona. I think they will try the civil rights angle to make it look good. I am also curious if Eric Holder will handle the matter himself. He is getting pretty good at humiliating himself in public.
